What EU Health Claims Actually Mean on a Fertility Supplement Label

Pick up any fertility supplement in Europe and you'll read that zinc "contributes to normal fertility and reproduction." Read a competitor's blog and you'll read that the same zinc "boosts fertility" or "improves sperm quality."

Only one of those is legal. Here's why the difference matters more than it looks.

The rule

Regulation (EC) No 1924/2006 governs what may be said about food in the EU. Under it, a health claim may only be made if that exact claim has been assessed and entered into the EU Register of authorised health claims. If a claim isn't in the Register, it cannot be used — no matter how much research exists behind it.

A second rule sits on top: Article 7(3) of Regulation 1169/2011 prohibits attributing to a food the property of preventing, treating or curing a human disease. No exceptions, no authorisation route.

What this means in practice

Only a handful of nutrients have authorised claims connected to reproduction:

  • Zinc contributes to normal fertility and reproduction, and to the maintenance of normal testosterone levels in the blood.
  • Selenium contributes to normal spermatogenesis.
  • Folate contributes to maternal tissue growth during pregnancy.
  • Vitamin B6 contributes to the regulation of hormonal activity.

That's essentially the list. Myo-inositol, N-acetyl cysteine, L-carnitine, L-arginine, coenzyme Q10, maca, ashwagandha — none has an authorised EU claim for anything.

The word "normal" is doing real work

Notice that every authorised claim says normal. Zinc contributes to normal fertility. It does not increase fertility, improve it, or raise your chances of conceiving.

The distinction is meaningful, not bureaucratic. These claims describe a nutrient's contribution to a body function working as it should when you're adequately supplied. They are not a statement that more produces better, and they are not a promise about outcomes.

The 15% rule

A claim can only be made if the product actually contains a meaningful amount — at least 15% of the Nutrient Reference Value per daily dose. A product with a token dusting of zinc cannot legally make the zinc claim.

This is why the %NRV column on a label is worth more attention than the marketing copy. It tells you whether an ingredient is present in a quantity that does something, or present so it can appear on the front of the box.

How to read a label

Check whether doses are published at all. A "proprietary blend" with no per-ingredient amounts tells you nothing.

Look for the word "normal." Claims using it are following the Register. Claims promising improvement, enhancement or boosting are not.

Be suspicious of ingredients described in detail but without a claim format. If a page tells you at length what inositol does for ovulation, it has stepped outside what's permitted — which tells you something about how carefully the rest was written.

Why we publish it this way

Our own products contain myo-inositol, NAC, L-carnitine, L-arginine and coenzyme Q10. We publish the dose of every one and say nothing about what they do, because saying it would be unlawful.

That looks like a weaker page than a competitor's. We think it's a more honest one.

Auf fast jedem Kinderwunsch-Präparat in Europa steht, dass Zink "zu einer normalen Fruchtbarkeit und Reproduktion beiträgt". In manchen Blogs lesen Sie, dasselbe Zink würde die Fruchtbarkeit "steigern". Nur eine dieser Aussagen ist zulässig.

Die Regel: Die Verordnung (EG) Nr. 1924/2006 erlaubt gesundheitsbezogene Angaben nur, wenn sie im EU-Register zugelassener Health Claims eingetragen sind. Zusätzlich verbietet Artikel 7(3) der Verordnung 1169/2011, einem Lebensmittel Eigenschaften der Vorbeugung, Behandlung oder Heilung einer Krankheit zuzuschreiben.

Zugelassen im Zusammenhang mit Fortpflanzung sind im Wesentlichen nur:

  • Zink trägt zu einer normalen Fruchtbarkeit und Reproduktion sowie zur Aufrechterhaltung eines normalen Testosteronspiegels im Blut bei.
  • Selen trägt zu einer normalen Spermabildung bei.
  • Folat trägt zum Wachstum des mĂĽtterlichen Gewebes während der Schwangerschaft bei.
  • Vitamin B6 trägt zur Regulierung der Hormontätigkeit bei.

FĂĽr Myo-Inositol, N-Acetyl-Cystein, L-Carnitin, L-Arginin, Coenzym Q10, Maca oder Ashwagandha gibt es keine zugelassenen Angaben.

Das Wort "normal" ist entscheidend. Zink trägt zu einer normalen Fruchtbarkeit bei. Es steigert sie nicht. Diese Angaben beschreiben den Beitrag eines Nährstoffs zu einer normal funktionierenden Körperfunktion bei ausreichender Versorgung — sie sind kein Versprechen auf ein Ergebnis.

Die 15-Prozent-Regel: Eine Angabe darf nur verwendet werden, wenn das Produkt mindestens 15% des Nährstoffbezugswerts (NRV) pro Tagesdosis enthält. Deshalb ist die %NRV-Spalte auf dem Etikett aussagekräftiger als jeder Werbetext.
